This Privacy Policy is formulated in accordance with the Personal Data Protection Act 2010 (“Act“), which describes how your information (“Personal Data”) is collected and used and your choices with respect to your Personal Data. For absolute clarity, any reference to “we”, “our” or “us” in this Privacy Policy shall include any member of SOFIT Sdn. Bhd. 1) Information Collected By The Website

Our Websites’ servers do not automatically recognize specific information about individual users on our Website. In addition, our servers do not automatically record information regarding a User’s e- mail address unless the User supplies it.

We collect information about Users during the registration process for certain parts of our sites; and through the use of cookies. We use this to help diagnose problems with our server, and to administer our Website.

We are responsible for the Personal Data under our control, including Personal Data disclosed by us to a Vendor (often referred to as the data processor and third party service providers). “Vendor” in this Privacy Policy means in relation to Personal Data, any person or entity (other than our own employee) who processes the Personal Data on behalf of us and/or who provide third party services for us. “Processing“, in relation to Personal Data means for example obtaining, recording, holding or using the Personal Data in carrying out any operation or set of operations on the Personal Data and/or providing its respective services to us.

We take every measure to provide a comparable level of protection for Personal Data should the information be processed by a Vendor.

We use and disclose aggregated non-personally identifying information collected through the Website as part of our organization’s process of constantly improving the Website, the products and services offered by SOFIT Sdn. Bhd.

4) Storage And Retention Of Personal Data

Your Personal Data shall be stored either in hard copies in our offices or in servers located in Malaysia. It may be necessary to transfer your Personal Data to third party services providers based/located outside Malaysia. By continuing to use the Website, products and/or services of SOFIT Sdn. Bhd., you hereby consent to such transfer.

Any Personal Data supplied by you will be retained by us as long as necessary for the fulfilment of the Purposes stated in paragraph (2) above or as required to satisfy legal regulatory, accounting requirements or to protect our interests.

Save and except as provided in paragraph (11) hereof, we do not offer any online facilities for you to delete your Personal Data held by us.

5) How Enquiry Messages Are Being Handled

We may preserve the content of any email that we receive.

Any Personal Data contained in those messages will only be used or disclosed in ways set out in this Privacy Policy.

The message content may be monitored by our service providers or employees for purposes including but not limited to compliance, auditing and maintenance or where email abuse is suspected.

The Personal Data Protection Act 2010 (the “Act”), which regulates the processing of personal data in commercial transactions, applies to the SO FIT group of companies, including but not limited to SO FIT SDN BHD and SOFIT PT STUDIO SDN BHD (including its trading names and related fitness brands) (“our”, “us” or “we”). For the purpose of this notice (“Notice”), the terms “personal data” and “processing” shall have the same meaning as prescribed in the Act.

Akta Perlindungan Data Peribadi 2010 (“Akta” tersebut) yang mengawal selia pemprosesan data peribadi dalam transaksi komersial, terpakai kepada Kumpulan Syarikat SO FIT yang termasuk tetapi tidak terhad kepada SO FIT SDN BHD dan SOFIT PT STUDIO SDN BHD (termasuk nama dagangan dan jenama kecergasan yang berkaitan) (“kami”). Untuk tujuan notis ini (“Notis”), terma-terma “data peribadi” dan “pemprosesan” mempunyai maksud yang sama seperti yang ditakrif dalam Akta tersebut.

1. Consent/ Persetujuan

This Notice is intended to inform you that your personal data is being processed by us or on our behalf when you use our services including gym access, personal training, group classes, events, and online platforms, including our official website at my (“Website”) (collectively “Services”) and you hereby give your consent to the processing of your personal data.

Notis ini bertujuan untuk memaklumkan kepada anda bahawa data peribadi anda sedang diproses oleh atau bagi pihak kami apabila anda dengan menggunakan perkhidmatan kami termasuk akses ke gimnasium, latihan peribadi, kelas berkumpulan, acara, dan platform dalam talian, termasuk laman web rasmi kami di sofit.my (“Laman Web”) (secara kolektif “Perkhidmatan”) dan anda dengan ini memberikan persetujuan anda bagi pemprosesan data peribadi anda.

c) ensuring the performance by you of your contractual obligations to us;

d) verifying and carrying out financial transactions in relation to payments made by you and administering and processing any payments related to products and/or the Services purchased by you;

9. Third party personal data/ Data peribadi pihak ketiga

We may require your assistance if the personal data relating to other persons is required to process your personal data for the Purposes and you hereby agree to use your best endeavors to assist us when required. In the event that personal data of any third party is supplied by you to us, you shall ensure that such third party has read this Notice and consented to us collecting his/her personal data for any of the Purposes prior to the supply of his/her personal data to us. Where another person is providing/submitting any of your personal data to us, you agree that you have authorised the disclosure of your personal data to us and consented to the processing of your personal data by us in accordance with this Notice.

Jika orang lain memberikan/mengemukakan data peribadi anda kepada kami, anda bersetuju bahawa anda telah memberi kebenaran untuk pemberian/pengemukaan data peribadi anda dan anda bersetuju dengan pemprosesan data peribadi anda oleh kami selaras dengan Notis ini.

10. Obligatory personal data/ Data peribadi wajib

It is obligatory that you supply us the details marked with an asterisk (*) in our forms (collectively, “compulsory personal data”). If you fail to supply us with any of the compulsory personal data, we may refuse to process your personal data for any of the Purposes. This may result in us being unable to provide you with the Services and/or products requested for and/or the termination of any arrangements/agreements with us. This may include name, contact number, emergency contact details, and health declaration for safe participation in fitness activities.

Ia adalah wajib untuk anda memberikan kepada kami butir-butir yang ditandakan dengan asterisk (*) dalam borang kami (secara kolektif, “data peribadi wajib”). Jika anda tidak memberikan kami mana-mana data peribadi wajib tersebut, kami boleh enggan memproses data peribadi anda untuk mana-mana Maksud-maksud tersebut. Ini akan menyebabkan kami tidak dapat membekalkan anda produk dan/atau Perkhidmatan yang diminta dan/atau mengakibatkan penamatan apa-apa urusan/perjanjian dengan kami. Ini mungkin termasuk nama, nombor telefon, butiran orang untuk dihubungi ketika kecemasan, dan deklarasi kesihatan untuk penyertaan selamat dalam aktiviti kecergasan.

11. Transfer of personal data to places outside Malaysia/ Pemindahan data peribadi ke tempat di luar Malaysia

We may transfer your personal data to a place outside Malaysia for any of the Purposes including where our data storage, membership management, or booking systems are hosted overseas (subject to such transfers being in compliance with the Act) and you hereby give your consent to the transfer.

13. Amendments/ Pindaan

In the event of any inconsistency between the English version and the Bahasa Malaysia version of this Notice, the English version shall prevail over the Bahasa Malaysia version.

Sekiranya terdapat apa-apa ketidak-konsistenan antara versi Bahasa Inggeris dan versi Bahasa Malaysia Notis ini, versi Bahasa Inggeris akan mengatasi versi Bahasa Malaysia.
